Can retailers legally ask for my receipt as I’m leaving the store?

In the United States, it is common for retailers to ask customers to produce a receipt for their purchase prior to leaving the store. This practice is legal and is intended to act as a barrier against merchandise and financial losses due to the unauthorized taking of merchandise - better known as shoplifting.

However, there are several other valid reasons why retailers perform receipt checks aside from deterring and identifying instances of intentional theft. One such reason has to do with cashiers, not customers.

Retail cashiers have a responsibility to examine the contents of customers’ shopping carts from top-to-bottom, but items are often missed as a result of poor training, complacency, and laziness. Bulky items, such as bags of dog food or cases of water that are placed at the very bottoms of shopping carts, are easily missed by cashiers during the checkout process. Smaller items are sometimes placed inside larger items, such as bags and totes, and are also overlooked when cashiers fail to open the larger items for inspection. How military SALUTE reports can be used by civilians when calling 911 to report emergencies

In the United States Military, personnel are taught to report suspicious or hostile activities by using a tool known as the SALUTE report. The acronym SALUTE refers to: Size, Activity, Location, Uniform, Time, and Equipment. By using this tool, personnel are able to relay all of the pertinent information that commanding officers and first responding agencies would need in order to properly respond to any emergency situation.

Although the SALUTE report was designed specifically for the military, it can also be a great tool for anyone calling 911 to report an emergency.

Size – How many individuals are involved in the activity?

Activity – What specific activities are the individuals engaging in?

Location – Where did the activity occur? Where are the individuals now?

Uniform (clothing) – What are the individuals wearing? Do the individuals have any identifying features, such as tattoos, scars, or injuries?

Time – When did the activity take place? Is the activity still in-progress?

Equipment – Do the individuals have weapons or other equipment? Are there any vehicles involved?

An example SALUTE report:

911: “What’s your emergency?”

Caller: “There are two individuals walking slowly and looking into car windows in the parking lot of ABC Hardware Store at 123 Main Street. One individual is a male wearing a red jacket, blue jeans, and white shoes. The other individual is a female wearing a dark blue t-shirt, tan shorts, sandals, and has a large tattoo on her right leg. I first saw them in the parking lot at approximately 8:10 PM when they were dropped off by a silver SUV. The male appears to have a baseball bat and a crowbar and the female appears to be unarmed.”

Callers to 911 are often under immense stress and panic, requiring operators to spend precious time asking questions and prompting callers to extract the information needed to dispatch the appropriate response agencies. In some cases, this can be several minutes or longer. Using the SALUTE report to relay information to 911 operators will significantly reduce emergency response times by giving operators all of the information they need quickly and efficiently.

What is an affidavit and when would I need to use one?

Sworn affidavits may be the most powerful and most overlooked of all legal documents.

Affidavits are written statements in which the author of the statement swears or affirms that the information contained in the document is true and accurate. In other words, it is a legal means of giving one’s word as evidence in legal proceedings and in the performance of carrying out official business.

An affidavit does not hold any validity unless it is signed in the presence of a notary public. The notary public will inspect the written affidavit and place the author under oath to swear or affirm that the affidavit was written under the author’s own free will and without instances of coercion or duress. The author will sign the affidavit in the presence of the notary public, who will then sign, stamp, and emboss the affidavit to validate it.

A common misconception is that a person may only write an affidavit after being instructed to do so by a lawyer or a court of law. This is false, as any person may write an affidavit to serve as legally binding evidence in nearly any situation.

Examples of instances when affidavits are useful:

  • A job applicant may use an affidavit as evidence that he/she has obtained a specific college degree if the original diploma certificate has been lost

  • A person may use an affidavit to document a loss of health insurance coverage when applying for new coverage outside of an open enrollment period

  • A person completing a rental application may use an affidavit to document prior addresses or salary information when other means of proof cannot be obtained
